Coffee quality can be affected by factors beyond our control, including storage conditions after delivery and brewing methods used.

We shall not be liable for any failure or delay in performing our obligations under these Terms and Conditions due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

3.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Tempo Roasters operates, without regard to its conflict of law provisions. Your use of our services may also be subject to other local, state, national, or international laws.

3.2 Jurisdiction and Venue

Any legal action or proceeding arising under these Terms and Conditions shall be brought exclusively in the courts located in the jurisdiction where Tempo Roasters maintains its principal place of business. Before filing any legal claim, you agree to first contact us to attempt to resolve the dispute informally. We will work in good faith to resolve disputes through direct communication. If we cannot resolve the dispute within 30 days, either party may pursue formal legal remedies.

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of our services or these Terms and Conditions must be filed within one year after such claim or cause of action arose, or be forever barred.
